A consortium of lenders led by UCO Bank has sought central bank directions on pursuing recovery of dues from the Srei Group after loans worth about ₹30,000 crore to the Kolkata-based financier officially qualified to be moved to the list of non-performing assets (NPA) this quarter, two people aware of the development told ET.

The Srei Group, however, said it expects banks to chalk out a debt recast plan that will map repayment milestones to future cash flows.

Since the group entities involved are non-banking financial companies (NBFC), the lenders concerned compulsorily need the Reserve Bank of India‘s (RBI) approval to take the Srei Group to the National Company Law Tribunal (NCLT) for insolvency proceedings.

In response to a query from ET, a Srei Group spokesperson said the economic downturn and loan moratoriums provided by the regulator had affected operations. The group is now in discussions with banks to implement a restructuring scheme.

‘NPA Ratio to Take a Hit’
“We hope banks will decide on the debt realignment at the earliest so that the company can pay all its bondholders and other creditors,” a Srei spokesperson said in the mailed response to ET. “We are very hopeful that banks will propose a payment schedule in consonance with the company’s cash flow that will enable payments to all creditors and help run the company smoothly.”

To be sure, Srei Infrastructure Finance may become the next big bankruptcy candidate from the financial services space after Dewan Housing Finance (DHFL). Banks are free to classify loans to Srei Group as NPAs after the National Company Law Appellate Tribunal (NCLAT) lifted a stay earlier this month on marking such exposure as bad, setting aside a lower bench order.

“All banks will have to classify loans to Srei as NPAs this quarter and make the minimum provisions required,” said a person familiar with banking-sector exposure to the Srei Group. “Many banks have excess provisions; so, that should not be a cause for concern. But with such a big loan account slipping, the gross NPA ratio of some banks will increase at the end of the quarter.”Srei Infrastructure, and its subsidiary Srei Equipment Finance, together owe lenders and debenture holders a total of ₹30,000 crore. Kolkata-based UCO Bank is the lead lender, with more than ₹2,000 crore of exposure. State Bank of India (SBI)’s exposure to the group is also more than ₹2,000 crore.

Bankers say they have already set the ball rolling for recovery of loans by writing to the RBI and a regulatory nod to take the company through the bankruptcy courts could mean another DHFL-type insolvency process.

“Already two letters have been sent to apprise RBI of the conditions. If the central bank gives the permission, banks will go ahead with a court monitored process,” said a second person aware of the Srei-related banking-sector exposures. “It remains to be seen what the central bank’s response is.”

Indian Overseas Bank shares jump 20% as RBI removes it from PCA framework

Shares of Indian Overseas Bank on Thursday jumped 20 per cent after the Reserve Bank removed it from the Prompt Corrective Action Framework (PCAF).

The stock zoomed 20 per cent to ₹24.60 on the BSE. At the NSE, it gained 19.80 per cent to ₹24.50.

The Reserve Bank on Wednesday removed Indian Overseas Bank from the Prompt Corrective Action Framework (PCAF), following improvement in various parameters and a written commitment that the state-owned lender will comply with the minimum capital norms.

On a review of the performance of the IOB, the Board for Financial Supervision on the basis of the published financial results for 2020-21, found that the bank was not in breach of the PCA parameter, the RBI said in a statement.

The bank has provided a written commitment that it would comply with the norms of Minimum Regulatory Capital, Net NPA and Leverage ratio on an ongoing basis, it added.

The lender has also apprised the RBI of the structural and systemic improvements that it has put in place, which would help the bank in continuing to meet these commitments. “Taking all the above into consideration, it has been decided that Indian Overseas Bank is taken out of the PCA restrictions subject to certain conditions and continuous monitoring,” the central bank added.

IOB was placed under PCA in 2015.

As the cryptocurrency craze keeps on growing around the world, Nikhil Kamath, Co-founder of Zerodha and True Beacon, has a piece of advice for the crypto-crazy millennials: it’s okay to diversify your portfolio, but don’t put in anything beyond 1-5 per cent of your net worth in it.

A battle between the central banks and private cryptocurrencies has been brewing for some time and now it seems we are getting closer to a climax,” said Kamath, the co-founder of India’s largest stock trading platform by volume.

“Developments in China and some of the other parts of the world show that to some extent, cryptos do take away powers from central banks and governments. So they are bound to fight back,.and when they come out and try to regulate it and change it in one way or another, it will be interesting to see what happens and which side wins,” he said.

The 35-year-old fintech disruptor says he would put his money on the side of central banks and the governments not allowing cryptos to thrive beyond a certain extent.

Kamath says one should not have too much allocation to any one asset class, and crypto is a fairly volatile asset class. “If one is looking to diversify one’s portfolio, then it’s okay to invest 1-2-5 per cent of one’s net worth in cryptos. But do so only after understanding what it entails,” he said.

On Wednesday, the global crypto market cap stood at $1.89 trillion, down 3.65 per cent from the previous day, amid choppy trading. The total crypto market volume over the last 24 hours stood at $97.32 billion, down 14.64 per cent.

Beijing last Friday issued a blanket ban on all crypto trading and mining and cryptocurrency exchanges and providers of crypto services are since scrambling to sever business ties with mainland Chinese clients. Ten powerful Chinese government bodies, including the central bank, said overseas exchanges are barred from providing services to mainland investors via the internet — a previously grey area -z and vowed to jointly root out “illegal” cryptocurrency activities.

Kerala High Court asks Dhanlaxmi Bank to adjourn AGM

The petitioners had to move their candidature under Section 160 of the Companies Act after the board decided to defer their candidatures.

The Kerala High Court on Wednesday directed Dhanlaxmi Bank to refrain from concluding the annual general meeting scheduled for Wednesday (September 29). The single bench of the high court gave an interim order directing the bank to adjourn the AGM to a day after one month after transacting the businesses included in the agenda for the meeting.

The order by Judge PB Suresh Kumar came following a writ petition filed by KN Madhusoodanan, a shareholder of the company, P Mohanan and Prakash DL, seeking a direction to the respondents — the RBI and Dhanlaxmi bank — to discharge their statutory responsibilities under Section 160 of the Companies Act to inform the members about the candidature of the petitioners for the office of the director as mandated under Section 160(2) of the Companies Act.

The board of the bank arbitrarily rejected the applications of all five candidates, including prominent shareholder Ravi Pillai (B Ravindran Pillai) and former independent director PK Vijayakumar, filed under Section 160 of the Companies Act, a highly-placed source told FE. The petitioners had to move their candidature under Section 160 of the Companies Act after the board decided to defer their candidatures.

“The HC interim order has upheld the importance of shareholders in appointing directors. The bank rejected applications without any valid reasons. The AGM is supreme for any company, including banking company. Some of the directors who came to that position with the votes of majority shareholders are now behaving as if they were made directors by some other authority, and not by shareholders. The interim order of HC is an eye opener for all who try to belittle importance of shareholders in the administration of any company,” PK Vijayakumar said.

Soiled notes taking more space than usable ones, banks tell RBI, BFSI News, ET BFSI

Banks have conveyed to the Reserve Bank of India (RBI) that soiled notes are occupying more space in chests than the issuable currency, seeking an urgent intervention. Even as overall cash in the system has gone up, soiled notes are occupying more space, a senior bank executive said, suggesting an increase the chest cash holding limits till the soiled currency notes are lifted.

“RBI can take a policy decision for increasing the cash holding limits of currency chests if the soiled currency notes exceed a certain percentage, say, 60% of chest space,” the banker said.

RBI regional offices can hand out approvals for increasing the cash holding limits, the person said. The central bank has embarked on a ‘clean note policy’, which includes retrieval and processing of banknotes received from currency chests and destruction of soiled banknotes in an automated manner.

According to the RBI annual report, there was a higher than average rise in banknotes in circulation in 2020-21 primarily due to precautionary holding of cash by the public due to the Covid-19 pandemic.

The value and volume of banknotes in circulation increased by 16.8% and 7.2%, respectively, during 2020-21, as per the report. In value terms, the share of Rs 500 and Rs 2,000 banknotes together accounted for 85.7% of the total value of banknotes in circulation as on March 31, 2021, against 83.4% a year earlier. The report further said the pandemic also affected disposal of soiled banknotes although it was expedited during the latter part of 2020-21.

“Despite efforts, the year as a whole still witnessed a 32% decline in the disposal of soiled banknotes as compared to the previous year,” the report noted. At present, there are 3,054 currency chests of which 55% are with the State Bank of India (SBI).

“We anticipate that as the informal economy gathers pace as the country emerges from the shadow of the Covid-19 pandemic, there will be a greater demand for currency notes,” a second bank executive said.

Some industry participants suggest that the central bank should comprehensively update its currency chest policy. “They should allow private third party non-banking entities to operate currency chests for greater cost efficiency,” said Rituraj Sinha, group MD at private security firm SIS India.

RBI is in the process of introducing varnished banknotes in Rs 100 denomination on a field trial basis with a view to elongate the life of the banknotes.

From tomorrow, your standing instructions for bill payments to your bank won’t be honoured, till the bank develops an alternate system.

A huge number of credit and debit card users set auto payment instructions for utility services ranging from electricity and gas and subscription services for music, movies and other media. The new rules may lead to lead to chaos for millions of users.

Dashing messages

Banks are sending communications to customers saying that they will not process the recurring payments and customers will have to make payments directly to merchants.

“Attention! From 1st Oct’21, as per RBI guidelines on e-Mandate on cards, we will decline Non Compliant recurring txn at Merchant Web/App on your Credit/Debit Card. Alternate Solution – Retry regular payment on Merchant Web/App authenticated via OTP or Pay via AutoPay in BillPay on our NetBanking for your Electricity /Water/Gas/ Landline/Postpaid mobile/Broadband/Insurance billers,” said a message to customers by HDFC Bank.

Banks and payment aggregators are rushing to meet the October 1 deadline for implementing a new system for standing instructions for recurring online transactions as RBI may not extend it.

“In compliance with the regulatory requirements, we are currently building a solution to seamlessly manage all your domestic standing instructions for recurring payments. This solution will be available soon for you. Starting October 1, any existing standing instruction for domestic and international recurring transactions on your card account will not be processed. We request you to make these payments directly to the service providers to avoid any interruptions,” American Express said in a recent message to customers.

How does the new system work?

Under the proposed system, as a risk mitigating and customer facilitation measure, the card-issuing bank will have to send a pre-transaction notification to the cardholder, at least 24 hours before the actual charge or debit to the card. While registering e-mandate on the card, the cardholder shall be given the facility to choose a mode among available options (SMS, email, etc.) for receiving the pre-transaction notification from the issuer. On receipt of the pre-transaction notification, the cardholder shall have the facility to opt-out of the particular transaction or the e-mandate. For transactions above Rs 5,000, banks will also be required to send one time passwords to customers.

What is a standing instruction?

A standing instruction is a service offered to customers of a bank, wherein regular transactions that the customer wants to make are processed as a matter of course instead of initiating specific transactions each time.

This service relates to transactions like renewing subscription to OTT platforms, newspapers and magazines, and utility bill payments.

The issue

Large lenders and payment entities including State Bank of India, ICICI, Citi, HDFC, Axis, HSBC, Visa and Mastercard had asked the Reserve Bank of India (RBI) to postpone the deadline for putting in place a new system to alert customers on ‘standing instruction’ transactions.

The banks were asked to set up the system by March 31, 2021.

The lenders also wanted RBI to exclude transactions against pre-existing standing instructions and those with international merchants from the new conditions for e-mandates on cards for recurring transactions.

Along with taking penal action against banks, the Reserve Bank is making its displeasure over their functioning known to them.

The central bank has been issuing ‘displeasure’ letters to expressing dissatisfaction over their functioning, according to a report. These letters are issued by the Department of Supervision, which does not take any enforcement action.

The intent of these letters is not to interfere in the functioning of the banks, but to suggest changes that are deemed necessary for course correction. The letters have had the desired effect and prod the boards to make necessary changes.

Regulatory action

The Reserve Bank of India (RBI) took enforcement action against 41 regulated entities by imposing an aggregate penalty of Rs 61.15 crore between July 1, 2019, and June 30, 2020, the bank said in its annual report.

The actions were taken against regulated entities for non-compliance of various regulations, the RBI said in its annual report. Enforcement actions were also undertaken against contravention of the directions pertaining to third-party account payee cheques; non-compliance with directions contained in risk mitigation plan (RMP); and failure to comply with the provisions of Section 10B of the Banking Regulation Act, 1949, among others.

The RBI undertook enforcement action and imposed fine for non-submission of compliance to risk assessment reports’ (RAR) findings; non-compliance with/ contravention of directions on fraud classification and reporting; not adhering to discipline while opening current accounts, etc.

As many as 26 penal actions were taken against public sector banks with an aggregate fine of Rs 38.35 crore, while eight were initiated against private sector banks with an aggregate fine of Rs 8.55 crore. With regard to cooperative banks, it said 13 penal actions were taken with imposition of Rs 9.18 crore, it said. During the period, it said, a total fine of Rs 5 crore were imposed on two foreign banks.

The Reserve Bank of India today lifted Prompt Corrective Action restrictions from the Indian Overseas Bank, the central bank said in a release.

The decision came after the bank reported its earnings for the year ended March 31, 2021, and the RBI observed that IOB was not in breach of the PCA parameters.

IOB has also provided a written commitment that it would comply with the norms of Minimum Regulatory Capital, Net NPA and Leverage ratio on an ongoing basis and has said that it would make structural and systemic improvements, RBI said in the release.

The RBI has said that it will continue monitoring the bank.

PCA is triggered when banks breach regulatory norms such as return on asset, minimum capital, among others.

Earlier this month, RBI had lifted PCA restrictions on UCO Bank. Now, only Central Bank of India remains in the list.

Unified Payments Interface (UPI) transactions more than doubled in value in July over the year-ago period, outstripping payment by cards, which went up 42%, according to the latest Reserve Bank of India (RBI) data.

UPI transactions by value touched their highest ever in July at Rs 6.06 lakh crore, surpassing the previous record of Rs 5.47 lakh crore in June and up from Rs 2.91 lakh crore a year ago. Card spending at Rs 1.36 lakh crore in July, on the other hand, was the highest since April and rose from Rs 95,883 crore in the year earlier as the economy recovered.

UPI platforms saw a 109% jump as consumers took to digital payments for daily essentials at local stores as well as premium purchases.

“We are observing that a majority of online payments are through UPI platforms and apps such as Cred,” said Riyaaz Amlani, chief executive of Impresario Handmade Restaurants, which runs the Social, Smoke House Deli and Salt Water Café chains. Amlani said UPI adoption is rising as average order value at outlets has increased 20% after the pandemic’s second wave.

While the economy shows signs of recovery, discretionary spending using cards has grown but couldn’t match UPI, executives said.

Banks, Retailers Note Trend

Digital payments made on wallets and UPI platforms by volume rose to about 3.25 billion in July, from 1.5 billion a year ago. The number of payments using cards was 520 million, compared with 450 million a year earlier.

Le Marche Retail chief executive Amit Dutta said the premium grocery chain has observed the trend within stores as well as in-home transactions. “UPI payments are showing increased traction in the past year, driven by convenience and the transactions being contactless, compared to card swiping, where contact points are higher,” he said. Consumers not previously comfortable with UPI payments have overcome their initial hesitation, Dutta said.

Banks executives said card payments are also growing, though UPI platforms are growing faster.

“UPI growth rate is and will outstrip cards, and it comprises both peer-to-peer and merchants payments,” said Axis Bank head for cards and payments Sanjeev Moghe. “Cards are only for payment to merchants. As long as the cards segment is growing at over 30-40%, it is quite healthy.”

UPI, payment platforms and wallets account for 10-15% of sales at leading electronics retail chain Vijay Sales, said its director Nilesh Gupta, up from almost nil just a year ago. “Consumers are even buying high-ticket items through such modes. These platforms often offer cashback incentives to entice customers,” he said.

Digital Adoption

The government and the RBI have been focusing on facilitating digital adoption by enhancing acceptance infrastructure and introducing innovative payment options to deepen the reach of payment systems.

“UPI transactions have moved the needle substantially in the past 12-15 months for neighbourhood grocery stores, riding on three reasons — convenience, instant credit and contactless transactions,” said Prem Kumar, founder of Ratan Tata-backed retail tech company SnapBizz, which devises technology for over 30,000 kirana stores and does business transactions of over $1 billion a year.

RBI said in its latest annual report that efforts were also directed toward ensuring smooth functioning of all payment systems despite disruptions in movement and access to infrastructure caused by the Covid-19 lockdown, with varying intensity and duration across various locations in the country.

Remittances also contributed a chunk of UPI volume. The platform is expected to see more traction once all banks develop systems to support inward remittances on UPI platform, said Emil Ruban, country manager India at Ria Money Transfer. “Many banks are yet to develop cross-border money transfer facilities,” he said.

A Euromonitor report said the trend is expected to continue, with increasing acceptance of UPI. “A large number of consumers started using UPI transactions for daily shopping activities especially at local retail stores, with the outbreak of the pandemic,” said Euromonitor consultant Vishnu Vardhan.
